TERMS & CONDITIONS FOR ENTERING PREGNANCY BUMP & BABY COMPETITIONS:

Entering Pregnancy BUMP & baby competitions constitutes acceptance of the following terms and conditions;

• Pregnancy BUMP&baby takes no responsibility for late or misdirected entries.
• Competitions are open to New Zealand residents only.
• Prize winners are drawn randomly.
• Prizes are not transferable and not redeemable for cash and no exchanges will/can be made.
• No correspondence will be entered into.
• Other conditions may apply.
• Winners will be notified by email.
• By entering competitions you agree that your email address may be added to the Pregnancy BUMP&baby database.
• Entry is consent to use name for publicity purposes.
• Competition dates will be shown on each competition separately

Terms and conditions FOR Sample Boxes

• Payment must be received before the sample box is sent out
• Due to the value of the order, no refunds can be given
• Due to the stock availability, there may be small variations in the type/colour/flavour of the product or sample that you receive
• Due to stock availability, some products may be swapped out by others, but the value of the box will remain the same
• Due to the nature of the box, some products may be short dated

TERMS & CONDITIONS FOR BUMP & BABY COURSES

BUMP&baby is owned by Learn About NZ, and runs a variety of activities including BUMP&baby magazine, bumpandbaby.co.nz, bumpandbabymall.co.nz, Tots To Teens Magazine, totstoteens.co.nz, Travel NZ With Kids and The Teen Age.

By accessing and/or using the BUMP&baby website and courses (the ‘Site’), you agree to be bound by these Terms and Conditions.

BUMP&baby may vary these Terms and Conditions at any time without notice and your continued use of this Site following any such changes indicates your acceptance of those changes.

In the Site, a reference to “us”, “we” or “our” is a reference to BUMP&baby.

The information on our “Site”

All intellectual property on the Site are either owned by or licensed to us. You must not reproduce, transmit, communicate, adapt, distribute, sell, modify or publish or otherwise use any of the material on the Site, except as permitted by law or with our written consent. However, you may print out and/or download information contained on this Site specifically stated as suitable to download, for your own personal and non-commercial use. Some information about products on the Site is based on material provided by third party suppliers and manufacturers. Except as required by law (including the New Zealand Consumer Law) we are not responsible for inaccuracies or errors caused by incorrect information supplied to us or by these third parties. It is possible for a variety of reasons that some products may differ slightly from the way they appear on the Site.

Whilst all care and effort has been taken to provide accurate information on the Site and in our products, the information is general in nature and may not be applicable for or suitable to your individual circumstances. It is important to understand that the information is intended as a guide only and is not intended to replace an individualized consultation with a qualified health professional. If you have any concerns about your or your child’s health or behaviour, or any questions about whether the advice contained in the Site or in any product is suitable for you or your baby, please consult with your qualified health professional.

We exclude all liability of any kind for the transmission or the reception of or the failure to transmit or to receive any material of whatever nature. You should not rely on any information accessed using the Site to make a purchasing decision – you should make your own enquiries before forming your own opinion and taking any action based on any such information. It is your responsibility to ensure that the products are sufficient and suitable for your purposes and meet your individual requirements. We do not warrant that the products will meet your individual requirements. You acknowledge that the products are standard and not made bespoke to fit any particular requirements that you may have. To the extent permitted by law in no event shall we, our affiliates and related entities or our suppliers be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with the Site, our services or these Terms. Our total liability under any contract shall in no circumstances exceed the value of the product (or cost of repair of the product).

Links to some third party websites have been included on the Site. BUMP&baby has not been involved in the design of those third party websites and has no control over the content or privacy policies of such third party websites. The content of third party websites can change at any time without notice to BUMP&baby. The inclusion of links on the Site does not imply that we have verified or endorsed the content of such linked third party websites.

Information on the Site may change without notice and we may change the content of the Site, and/or suspend or discontinue the Site at any time without notice.

We take pride in providing relevant and credible information in our courses, and to ensure it is presented in an easy to access format. Our products are provided on the basis that they are used in accordance with their terms – if you choose not to follow all or part of the information, or suggested guides within our products, then the product may not work for you.

Using our “Site”

You must only use the Site in accordance with these Terms and any applicable laws.

Whilst care has been taken to prevent the introduction of viruses onto the Site, BUMP&baby does not guarantee that the Site, or any product purchased from the Site, is free from viruses. You are responsible for protecting your own computer or mobile device from being affected by viruses whilst using the Site. BUMP&baby is not responsible if you are not able to access or use the Site due to any virus or for any loss or damage you any suffer as a result of a virus affecting your computer or mobile device. You also agree to take reasonable precautions to prevent the introduction or spread of any software contamination, including viruses, in the Site when accessing, providing or downloading information via the Site.

To the extent legally permitted, none of BUMP&baby, any of its employees, agents and advisers, or any other party, accepts any responsibility or liability for any direct or indirect loss or damage that may result from any errors or omissions on the Site, reliance on information contained in the Site or in any product provided through the Site, or access to, or use of, or inability to use, the Site.

Indemnity

You indemnify and hold us and our related entities, affiliates, and our and their respective officers, agents, and employees, harmless from and against any and all claims, demands, proceedings, losses and damages (actual, special and consequential) of every kind and nature, known and unknown, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms or your breach of any law or the rights of a third party.

Placing your order and contractual obligations

You must pay for the order in full at the time of ordering by one of the payment methods we provide on the Site. You must be entitled to use the payment method or account that you use to place orders on the Site. We reserve the right to obtain validation of your payment details before providing you with the product. If you discover that you have made a mistake with your order after you have submitted it, please contact us immediately. However, we cannot guarantee that we will be able to amend your order in accordance with your instructions. When you place an order, you will receive an email confirmation from us. A contract between us for the purchase of the goods or service will be formed at this time. We may in our discretion refuse to accept an order from you for any reason, including but not limited to unavailability of stock or service providers or we suspect that you might on sell our products to other consumers.

No refunds are given for Courses, as full access to all content is given at the time of purchase. However, if you need to amend details of your account, and you are unable to do this through your login, please contact us at admin@BUMP&baby.co.nz.

BUMP&baby does not guarantee the continued availability of the Site or the continuation of any services provided on it and access to the Site may be interrupted, restricted or delayed from time to time. BUMP&baby does not accept any responsibility or liability in relation to any loss suffered in these circumstances.

Privacy and communication

BUMP&baby takes your privacy seriously. Any personal information you provide directly or indirectly while accessing the Site, including as a result of purchasing products from the Site, are governed by this Privacy policy.

BUMP&baby collects personally identifiable information about you such as your full name, email address, mailing address and telephone number only in order to administer your membership or support requests. You will receive information from BUMP&baby regarding Courses (including information as part of the Course you are taking and about additional Courses)  and BUMP&baby Magazine offers. If you choose to subscribe to our general newsletter, BUMP&baby will use your email address in a confidential manner to send you promotional material.

Under the Privacy Act 1993, you have the right to access and request correction of any of your personal information held by BUMP&baby.
